TMPCWA STAGE 17 DAYS CAMPING IN
FRONT OF THE DEPARTMENT OF LABOR AND EMPLOYMENT OFFICE
Last August 15 to
Septemnber 1, TMPCWA setup a camp in front of the Department of
Labor and Employment to stage protest action and to call the
attention of the Labor Secretary to act in line of the ILO
Recommendation and to seek Justice on the 17 years long standing
labor-dispute between Toyota and the 233 + 4 illegally dismissed
Toyota workers.

TMPCWA CAMPED OUT AT THE
GATE OF THE PRESIDENTIAL PALACE
Last July 17 to 23, 2017, TMPCWA
participated in the workers camp out, together with the
workers coming from Southern Mindanao Region, Caraga, Southern
Tagalog Region, and Metro Manila, to remind the Duterte
Government to fulfill his promises to the Filipino workers
during his presidential campaign that
he will end contractualization in the Philippines . It was already one year ago when
President Duterte made his promises but, unfortunately, it did not happened.
Instead of ending contractualization, more
oppression has been made against the rights of workers and
worse, they found a way of legalizing contractualization
through the new Department Order
174 released by the Department of Labor and Employment.
TMPCWA participated in the
camp out hoping for the chance that the 17 years of
struggle of the 233+4 illegally dismissed workers can be
included in the dialogue with the president. Unfortunately,
because of the many huge issues that was happening in the
country like the Martial Law in Mindanao and the workers
worrying for its extension and expansion to the whole country.
Nevertheless, TMPCWA struggle campaign was a success because
of wide range of projection not only to the media but to the
Filipino people who witness the workers camped out.
The illegally dismissed
members of TMPCWA are in high-morale in the result of these
campaign because it reminds them the first workers strike that
taking place in front of two factories of Toyota way back 17
years ago. Illegally dismissed workers and families keeps their
strong faith that someday they can get victory. They promised to
do the same camping action in front of the Department of Labor
and Employment next month to push the Government to act
accordingly after Toyota management suspends the last February
settlement negotiation.
TMPCWA is calling
everybody to continue to support the 17 years struggle of the
illegally dismissed workers and to support the next camping
action to DoLE this August as part of the SHAME ON GEORGE TY -
TOYOTA CAMPAIGN of the union.###

PARALLEL ACTIONS OF
TMPCWA AND THE SUPPORT GROUP FOR TMPCWA IN JAPAN
Today TMPCWA staged a protest
action in front of the Department of Labor and Employment to
push the resumption of negotiation between Toyota and TMPCWA and
to pursue proper compensation of the 233 + 4 illegally dismissed
Toyota workers.
Last June 16, Support
Group for TMPCWA in Japan staged a protest action in front of
Toyota Tokyo Headquarters while the Support group in Toyota
Aichi for TMPCWA staged an action in Toyota City last June 14.
Series of actions will
continue as part of the continuing struggle of the illegally
dismissed Toyota workers against the arrogant behavior of Toyota
by not respecting to the rights of their workers. Toyota must pay
for all its crime to the workers illegally dismissed and their
families who lost almost everything because of its greed for
profits.

to Deadlock by Toyota
of Settlement Negotiation!
Illegally dismissed workers cry foul over Toyota Management’s
arrogance in settlement negotiation for a long-pending labor
dispute.

It's been 16 years since the illegal dismissal of 233 members
and officers of TMPCWA, and
for these
16 years, the workers are still fighting and seeking for justice
for the inhumane dismissal
perpetrated
by Toyota.
Now, with
the start of his term, the
President
has brought some optimism and hope to the workers as he promised
the Filipino people "change is coming".
On
January 13, 2017, TMPCWA and TMPC, for the first time after the
illegal dismissal, sat together
at the same
face-to-face talk
table facilitated by the Office of the Undersecretary Joel
Maglunsod of the DoLE,
to which
also present was a representative from the ILO
office of the Philippines.
During the talks, Toyota,
by its legal counsel,
insisted from the
beginning, on
the Supreme Court decision as the basis of any
possible solution
and that the ILO Recommendations are
not issued to Toyota but to the government of the country only,
so
not legally
binding on
Toyota.
Contrary to
such wrong and child-deceiving logic by
the management’s
legal counsel,
the ILO representative
pointed out
that the ILO recommendations are legally binding
on employers also of course,
because
the Philippines is a signatory
to
the ILO core conventions
that are established on the government-workers-employers
tripartite principle.
The meeting was continued to the next time bas mediated by Labor
Undersecretary for both parties to seek a solution.
The second meeting happened
on
January 27, 2017. Labor Undersecretary
summarized
facts about the case,
of which
the most important ones are listed as follows:
·
TMPCWA was declared Sole and Exclusive Bargaining Agent by the
dole in 2001 under the then labor Secretary Patricia Sto. Tomas.
·
The same day that the DoLE declared TMPCWA as SEBA, TMPC
dismissed 233 TMPCWA members including 9 officers.
·
Toyota made an appeal on the SEBA declaration up to the Supreme
Court but the highest court sustained that TMPCWA is SEBA and
that negotiations for CBA should begin.
·
Despite the Supreme Court ruling on TMPCWA as SEBA, Toyota did
not negotiate with TMPCWA and instead added 4 more TMPCWA
members in the illegally dismissed workers' list in 2010
·
Despite the existence of TMPCWA as SEBA, the DOLE recognized
another union, a company union, which made way for Toyota and
its management union to forge a CBA.
·
The NLRC decision declaring the attendance of TMPCWA members on
Bureau of Labor Relations of DOLE Clarificatory hearings as an
illegal strike also reached the supreme court and the ruling
penned by Justice Velasco was almost a photocopy of Toyota's
arguments hence TMPCWA described it as a "massacre".
·
TMPCWA case reached the International Labour Organization and
the ILO found out that Toyota interfered in the union formation
of TMPCWA and therefore violated Conventions (87 & 98) freedom
of association and collective bargaining.
·
November 2012, the ILO recommended that an "equitable negotiated
solution" should be reached by both parties with the Philippine
government's help through
DOLE,
and stated that
if reinstatement of the dismissed workers would be impossible
adequate compensation must be given to the dismissed workers.
This Recommendation was followed by 2013 and 2015
Recommendations because of Toyota’s disregard to it, in which
ILO stated it
will be monitoring the case
further.
The workers, who have long been denied of justice wants complete
indemnification for the livelihoods and lives ruined by the
dismissal, which summarily affected not just the workers but
also their families. In response to the workers’ cries, Toyota
Management is only offering TMPCWA P8,668,218.90 as financial
assistance to the remaining 75 workers who did not accept the
previous monetary offers by Toyota. This move clearly shows the
dividing tactics of the management to further destroy the unity
of the illegally dismissed workers.
Toyota is also offering TMPCWA an amount of not more than
P500.000.00 as livelihood
project,
provided that the government through DOLE, will also give TMPCWA
the same amount as counterpart and will be the "out-of-the-box
solution" to the conflict.
After learning these facts, Undersecretary Maglunsod said that
"there was a clear grand conspiracy between Toyota and the
DOLE under the previous Macapagal Arroyo and Aquino
administrations, and even the Judiciary. Usec Maglunsod also
encouraged Toyota to offer a substantial amount
on
the table, something that TMPCWA could ponder on.
Toyota then,
by
the legal
representatives, suddenly slammed Undersecretary’s
patient mediation seeking for a wise compromise by both parties
arrogantly by moving
to terminate this
conference
(settlement
negotiation)
immediately
because the gap between
the P8 million financial assistance offered by Toyota and the
indemnification demands of TMPCWA was too far apart to be
reconciled. The BLR
(Bureau of Labor
Relations of DOLE)
representative disagreed with the
Toyota’s
motion for
termination by
saying that if Toyota continues to hold on to the SC Ruling then
the negotiations will not move forward and that terminating the
conference is not in cognizance to the ILO Recommendations.
Despite the arrogance showed by the management, Usec Maglunsod
still encouraged Toyota to continue negotiations saying that
DOLE is always open to facilitate such
talk for solution.
He also
said DOLE will have to report
the current status
to the coming ILO High Level Mission that will visit the country
in February
and to
the ILO Governing Body meeting on the
middle of the year to defend the DOLE's position. He also
showed his
keen interest
in confirming if
there existed any
administrative order by
to implement
the ban on procuring Toyota vehicles
for official use
of the department as a consequence of Toyota's continued
violation of workers' rights
guaranteed by the ILO conventions. This fact was allegedly
exposed on the negotiation table by TMPCWA to ask if Toyota
legal counsel know about it. Usec
Maglunsod also
mentioned he is
willing to
bring
the issue to the office of the President
Duterte for any stronger act by the incumbent Administration.
Those are the
summary development of the long-awaited but egoistically
terminated settlement negotiation only after the initial two
rounds of it.
We
TMPCWA condemn Toyota's very arrogant attitude towards the
DOLE’s
painstaking
efforts for
the settlement of
our long-pending dispute.
This time’s
negotiation
clearly showed Toyota management’s
still unchanging
anti-labor-rights
stand and
practices
with
complete disregard to
considering and
giving
justice to the illegally dismissed workers.
We
TMPCWA, however, as proven in
by enduring this
long-drawn struggle,
are
not discouraged
at all
by this
unfortunate development.
It only
pushes us
to work and fight more to attain true and genuine justice.
We
TMPCWA
call
on the current Duterte administration and DOLE to continue to
intercede
with
further efforts
so as
to make Toyota recognize workers' rights and
admit
to be accountable for the injustice that
this globally
leading Japanese company
did to the workers
who stood up to self-organize to a trade union just to guard and
upgrade their rights and lives at it local subsidiary company in
the country. There is no amount of bullying,
money, and influence that will stop the workers from fighting
because TMPCWA's cause is a just cause. Surely, through their
constant unity and struggle, the workers’ rights and demands
will win by
all means eventually.

TO THE 233 ILLEGALLY DISMISSED WORKERS AND THEIR
FAMILIES
Today,
March 16, is the day where in the anger of the 233 illegally
dismissed workers by Toyota and George Ty are constantly
awakened and reminded to us because of the MASSACRE that they
have committed to the lives and livelihoods of the workers,
together with their families. This is the worst day to all the
workers that are illegally dismissed and also to their
families. The massacre has been perpetrated by Toyota because
they failed to suppress the victory won by the workers in
fighting for a genuine union inside the factory in the
leadership of TOYOTA MOTOR PHILIPPINES CORPORATION WORKERS
ASSOCIATION (TMPCWA).
FIFTEEN YEARS have passed since the
management illegally dismissed 233 leaders and active members of
the union TMPCWA, but Toyota and George Ty did not stop in
attacking the illegally dismissed workers. But still, for those
15 years of struggle, the Toyota management and George Ty failed
to crush or destroy the union TMPCWA. The continued struggle and
commitment of the illegally dismissed workers further expose the
failure of Toyota and George Ty to destroy the fighting spirit
of the workers and their inability to suppress the workers who
never gets tired of fighting for their rights in view of
attaining victory and genuine justice.
The determination to continue fighting by
the illegally dismissed workers can also be attributed to the
RECOMMENDATION of the INTERNATIONAL LABOUR ORGANIZATION that it
released since 2003, especially its recommendations on November
2012, October 2013 and November 2015, with its continued
releases of recommendations and analysis up to exposing the
truth about the illegal dismissal for fifteen years already.
The recommendations further exposed the UNION BUSTING attacks of
Toyota and George Ty against the illegally dismissed workers.
The truth about the current situation of
this long standing Labor Dispute are clearly showed by the
political victories gained by the union TMPCWA together with the
other workers that are still inside the factory that have also
been part of the union's struggle for the interests of the
working class. Even of the management and Toyota used different
kinds of deceitful maneuvers to destroy these facts, but the
truth remains that they failed in destroying the union. They
only continue to witness the constant protests of the illegally
dismissed workers in front of their own buildings, banks,
establishments and factory. Toyota should definitely think that
the only thing that could stop the workers from their continued
protest is to sit down and to launch a negotiation with the
workers as recommended by the ILO.
If Toyota will not adhere or implement
the ILO Recommendations of 2012, 2013 and 2015 and it will
continue to do dirty schemes and will to destroy the union, they
will also continue to experience defeat because TMPCWA WILL
ALWAYS CONTINUE TO FIGHT AND STRUGGLE FOR GENUINE SOCIAL JUSTICE
for the illegally dismissed workers. ###

Philippine National
Police blocked TMPCWA as they come close in front of the Japan
Embassy. The police also tried to disperse the protesters. But despite of
this, the protesters continue to hold their action to address
the appeal of the illegally dismissed workers to Japan Embassy
and the Royal Couple to make intervention and help the illegally
dismissed workers so as to talk to Toyota Japan and its
subsidiaries for the implementation of ILO Recommendations
favouring the 233 + 4 illegally dismissed workers by Toyota.

Re: Letter of Request
regarding the Settlement of Labor Dispute at TMPC
Dear Sir,
As you know well, there
exists in Your Company an unusual situation that Toyota Motor
Philippines Corporation (TMPC) as the Philippine local
subsidiary of Your Company has left such problem unsettled for
nearly 14 years that TMPC bulldozed a mass-dismissal of as many
as 233 workers in 2001 over an issue of the formation of our
union and our collective bargaining right and further dismissed
another four workers in 2010.
Regarding this matter, TMPC has
been issued oftentimes so far a Recommendation by the
International Labor Organization (ILO) to the effect that this
dismissal constitutes a violation of the International
Conventions honoring the right of workers to organize and their
collective bargaining right so that TMPC is urged to reach such
a settlement, through elaborated negotiation with the union by
getting help of the Philippine Government as intermediary, that
TMPC shall <cancel the dismissal and reinstate the dismissed
workers in their original workplace or, if it is impossible, pay
a proper compensation enough to make up for that>, which also
you should already know very well.
For these years the dismissed
workers and their families have been continuing their fight
gritting their teeth and enduring their bleeding-like hardship
with the determination that “We can never accept this illegal
dismissal unless and until the Company Management shows us their
faithful apology and compensation.”
However, the Company Management
not only has continued to regard the dismissed workers as being
just like garbage so that they do not greet the dismissed
workers as the other party of negotiation, but also is
cold-heartedly ignoring the intermediary efforts of the
Department of Labor and Employment that is now making strenuous
efforts for the settlement of this case representing the
Philippine Government.
What company on earth is it that
has left unattended a letter from a Secretary (Minister) of the
national government of one state, in which she politely and
humbly asked thoughtful consideration and response from the
company management, without even showing any gesture of going to
respond in due course? Though we do not know whether it is a
world-top leading multinational enterprise or not, we wonder if
there exists such a local company that can dare to show such an
arrogant attitude of derisively mocking the executive acts of
the government in the state in question. In fact such a company
is the Philippine subsidiary of Your Company, namely Toyota
Motor Philippines Corporation.
In facing with the fact that
such a cruel act is being taken in a developing country in Asia
by the local subsidiary, we cannot help but question the
governance ability and responsibility of its mastermind, namely
Your Company that is Toyota Motor Corporation in Japan as well
as You Yourself as the Representative Director and President
thereof.
And, the problem does not end
with this. We cannot help but point out that such attitude of
the Philippine local company is assumed under the direction of
Your Company that is Toyota Motor Corporation in Japan and You
Yourself as the Representative Director and President thereof.
The reason is because for some time after this dismissal was
bulldozed, Your Company was showing a sort of get-away attitude
by pretending that “Any local matter is dealt with locally,” so
as to evade the responsibility of the headquarters but later on
in the midst of severe criticism by a certain foreign
institutional investor as saying, “We are unable to make
investment in a company like Toyota which is blamed by ILO for
violating the rights of workers,” Your Company laid down
something named “Global CSR (corporate social responsibility)
Policy” in which Your Company, while saying on the surface such
beautiful words as. “We honor local, national and international
law and spirit thereof,” in order to veil the real intent, in
fact as far as the right of workers to organize is concerned,
has sneaked in a proviso to the effect that such right is
honored only within the scope of the law of a country in
question, thereby Your Company has made it clear to turn to a
confrontational stance. The reason why Your Company has decided
to turn to a confrontational stance as such regarding the
corporate social responsibility was because quite fortunately a
decision was released by the Philippine Supreme Court ruling out
that this dismissal by TMPC was effective. Though this decision
is quite problematic, the important point is that if you can
manipulate at will the government of a country where you invest,
you will be able to control the right of workers at will by
saying, “the right of workers is honored within the scope of the
law of a country in question.” Your Company has laid down such
an intrigued, tricky “Global CSR Policy” in a manner much the
same as “For a proposal in principle but Against
particular details of thereof” and is commanding all the local
subsidiaries in the world to follow this Policy, is it not?
TMPC Management is now boasting,
“As we have got the decision from the Philippine Supreme Court
ruling out that the dismissal is effective, we have no legal
responsibility for complying with ILO Recommendation.” This is
happening exactly because Your Company is commanding them to so
behave, is it not?
For instance, in case the
government of a developing country has to adopt a foreign
investment inducement policy as part of its economic policies,
it can happen that the government may curtail the rights of
workers in order not to get unpleasant foreign investors to take
their investment out and go back home, for that matter may favor
multinational enterprises by making the law courts to release a
decision ruling out the dismissal is effective even if workers
or union leaders are illegally dismissed just because they
exercised their legitimate rights of organization and collective
action seeking the improvement of their working conditions.
There must be many similar things that Your Company as well as
You Yourself remember concerning the subject matter in the
Philippines. In such cases, however, ILO is issuing Corrective
Recommendations as saying, “It may be so indeed in the law of
the country in question, but we cannot approve it from the
standpoint of international labor standards.” The cheap trick of
Your Company’s “Policy”, which seemingly looks excellent, has
already been seen through since a long time ago. This is the
stance of ILO and the significance of ILO Recommendation. Also,
this represents the big waves that are majestically flowing in
international society today.
We do believe that Your Company
as well as You Yourself know and recognize this already. We can
hardly believe that neither Your Company nor You Yourself know
anything about it at all. If neither Your Company nor You
Yourself know, it is quite problematic indeed for Your Company
and Your Yourself to continue business in such a situation with
a signboard of a top-brass multinational enterprise put up, and
if Your Company and You Yourself know it but do not comply with
it and dare to take the opposite attitude, Your Company as well
as You Yourself will, sooner or later, very likely be showered
by international society with a big criticism for being
malicious intentional criminals.
We from heart expect and request
that Your Company and You Yourself would immediately make a
brave decision to show us faithful apology and compensation for
the settlement of this labor dispute so that Your Company and
You Yourself may get a large applauding stamp from ILO and
society and from investors also as saying, “You are exactly the
Toyota we expected!” before things develop so worse and worse as
we are anticipating.

TMPCWA Statement for
2015
2015 – A year of unceasing struggle, firm
resolves to consolidate and unify and is full of hope for the
illegally dismissed workers of Toyota; and honor for the 14
years of continued struggle of the 233 + 4 leaders and members
of TMPCWA and their families.
2014 is the year that has been very significant,
for the 233 + 4 illegally dismissed workers to be more zealous
in mobilizing and more firm to struggle for this coming year of
2015, to continue the fight to look for and attain true and
genuine social justice that has been continuously denied by
Toyota – George Ty and the Aquino government. The hardships and
sacrifices that are experienced last year by the illegally
dismissed workers and their family were not at all easy. But all
the trials and sacrifices did not become a barrier for us not to
continue our fight and struggle against those that oppressed us.
The past year had been meaningful and full of
hope to reach a larger number of the workers that were illegally
dismissed and to further strengthen the unity amongst us for a
more active mobilization for the SHAME ON TOYOTA campaign and to
link the local owner of Toyota, George Ty as one of the
mastermind behind the illegal dismissal of the 233 + 4 workers
and to indict them for their crimes against the illegally
dismissed workers and the workers’ families.
The efforts and hard work for the illegally
dismissed leaders and members of TMPCWA, as well as their
families, will not end with the closing of 2014. On the
contrary, TMPCWA sees the coming year of 2015 with more hope and
continued struggle to commemorate the 14th year of
their fight for the attainment of true and genuine social
justice.
TMPCWA gives its highest tribute, not just to the
233 + 4 illegally dismissed workers and their families to their
unyielding resolve to remain firm in their fight, but also to
those that supported TMPCWA, both on local and international.
TMPCWA also extends its utmost gratitude to all those that
continues to echo the calls of TMPCWA on the international
community and also to continue to campaign for the
implementation of the November 2012 and October 2013 ILO
Recommendation for a just and equitable solution.
TMPCWA would also like to extend its deepest and
sincerest gratitude and tribute to the SUPPORT GROUP FOR TMPCWA
IN JAPAN and AICHI SUPPORT GROUP FOR TMPCWA, especially ZENZOSEN

Last August
29, 2014 TMPCWA continue the series of protest under its program
to launch SHAME On TOYOTA Campaign for almost nine months
already for the implementation of the November 2012 and October
2013 Recommendation of the International Labor Organization to
urge the Philippine Government and Toyota to find solution into
the long-standing labor dispute between the 233: + 4
illegally dismissed workers in Philippine Toyota subsidiary.
The members
of the union first gathered in front of G.T. Tower building
owned by George Ty in Ayala Makati, the business capital of the
City. George Ty is in partnership of Toyota and Akio Toyota the
owner of Toyota Japan for more than 25 years already. He is also
the owner of Metropolitan Bank and Trust Company as well as the
present Chairman of G.T. Capital Holdings who also investing to
energy and electricity in the country and the 6th of the top ten
billionaire in the country.
The illegally
dismissed workers are not only yelling for justice but also
would like to challenge George Ty and specially AKIO TOYODA into
a genuine CHALLENGE not in the like of social media Ice Bucket
challenge like he did but a challenge to resolve the more than
13 years of agony and sacrifices of the illegally dismissed
workers and their families which until now still ignoring by
George Ty and Akio Toyoda.
TMPCWA would
like to expose that Akio Toyota is not really accepting the ICE
Bucket challenge whole heartedly but only a mere social media
promotion like promoting freely of its product using the social
media technology trending. Almost all the people who entering
and exiting the door of the GT Tower building was very surprise
to look, watch and learned that the dispute still not yet over
like what Toyota and management people in the G.T. Tower having
told to them.
The next
protest action was in front of Toyota Makati (Toyota Bel-Air) a
sales office of Toyota in Makati City where the Managing
Director is Dabid Go, the Executive Vice President of Toyota
Motor Philippines Corporation (TMP). Here in this protest, the
illegally dismiss members trying to tell to Toyota management to
respect what the ILO is expressing to Toyota and the Philippine
Government to seek EQUITABLE NEGOTIATED SOLUTION.
The last part
of the protest is in front of the Department of Labor and
Employment building to protest to the government official to act
on this matter for and to listen to the voice of the illegally
dismissed workers for already 13 years now and to
implement the ILO Recommendation which is long overdue.###

SHAME ON TOYOTA CAMPAIGN
The series of
protest is continuing for the month of July for the Shame
on Toyota Campaign of the illegally dismissed workers of Toyota.
The 233 + 4 illegally dismissed workers is supporting this
campaign to keep in exposing Toyota and the Philippine
Government for not implementing the ILO Reccomendation of
November 2012 and October 2013 that urging Toyota and the
government to find equitable solution to end the more than 13
years of labor dispute in Toyota Philippines. It has been a very
long time which Toyota continue to keep its arrogant
behavior and selfish stance against the illegally dismissed
workers and their families.
The illegally
dismissed workers of Toyota will never stop to inform the public
about their stubborn treatment on the International labor
standard laws. The union CWA are appealing to all buyers of cars
not buy Toyota cars and all of its products, until the time
Toyota would be able to think what is the right thing to do
about this sufferings of the illegally dismissed workers. The
illegally dismissed workers demanded Toyota and the Philippine
Government to show some respect and restore the dignity of
illegally dismissed workers who only seeking for genuine justice
for more than thirteen years already.

Last May
10-11, TMPCWA launched a solidarity gathering to further
strengthen the unity of the illegally dismissed workers of
Toyota, together with their families and also those who already
accepted payments in light of the ideal of genuine trade
unionism.
It aimed
in gathering again the illegally dismissed members of TMPCWA
that already accepted payments from the company and to persuade
them to heed the call of the union to be one in their continued
fight and struggle to attain genuine social justice, which is
also the recommendation of the ILO based on its recommendation
on November 2012 and October 2013.
All the
members of TMPCWA who attended the gathering, and their
families, agreed and united that they will continue to be part
of the efforts to reach out to all the other members of the
union to intensify the SHAME ON GEORGE TY - TOYOTA CAMPAIGN and
to also launch series of continued protests and to continue to
expose the arrogance of Toyota and the inutile government in
derailing the implementation of the ILO Recommendation.
The
launching of their protests on May 26, June 9 and June 25 are
significant dates of protests that were united upon by the
members and families of TMPCWA in different Toyota Dealers owned
by George Ty and Toyota, and also at the Department of Labor and
Employment and the Japanese Embassy. ###

TMPCWA CELEBRATES
INTERNATIONAL WORKERS DAY
On May 1,
2014, TMPCWA illegally dismissed members and families
participated and celebrates the International workers day
together with various workers organization in Metro Manila. It
is a good chance for TMPCWA to call the attention of many locals
and unions under federation to support the campaign against
Toyota about the Shame on George Ty - Toyota Campaign that is
continuing since last November 2013.
In this May
-Day celebration, TMPCWA share the struggle by allowing to have
the members speeches in the program and the first performance of
the new established cultural group of TMPCWA, composed of
illegally dismissed members and families together with cultural
group of Advan workers and the Defend Job Philippines who sings
the real life-story of the workers.
Members and
families also learned many things about the national situation
on the visit of Barack Obama who signed the new treaty together
with the Philippine Government - the Enhance Defense Cooperation
Agreement to reestablished US Military bases again and another
plunder to the natural country's natural resources and the more
suppressive policies against the Filipino workers. The
dismissed members and families are very active now to advance
common interests of workers and the struggle of TMPCWA.

SHAME ON TOYOTA CAMPAIGN MONTH OF
APRIL PROTEST
Last April 3, 2014, TMPCWA
continued to launch Shame on George Ty - Toyota Campaign to
condemn the harassment made by the connivance of George Ty-Toyota
and Aquino Regime to the leaders of TMPCWA. The protest
was supported by various organization of workers and peoples organization in the Philippines. It
began in front of the
Department of Labor and Employment to support the calls of the
workers and the new graduate students to condemn the DoLE
against its contractualization policies and massive
unemployment. TMPCWA demanded that the DoLE must resolve the
long-standing labor-dispute between TMPCWA and Toyota and
implement the ILO Recommendation of November 2012 and October
2013.
After the
DoLE, the protest continued to the Department of Justice, to
demand the following: to stop and end the criminalization of
Philippine Government to labor leaders and other human rights defender and
activists. TMPCWA also shared the harassment experience of the
leaders of TMPCWA. After some speeches of the leaders, the
protesters went to the Japanese Embassy to condemn and remind
the Japanese government about their responsibility, which they
keep on ignoring, to educate their Japanese companies all over the
world to respect the workers very fundamental rights and also
reminded them to implement and respect the international
convention 87 and 98 specially to respect the ILO
recommendation to find solution for the case of TMPCWA.
After the
lunch break the protestors went directly to the Canadian and
Australian Embassy. This is to support the workers of Toota Australia
to fight together with them against the closure of Toyota
Australia which was publicly announced by Akio Toyoda
because of labor costs. Toyota made a huge amount of profit in
its Toyota Australia factory because it started its production
and selling of cars and its auto components since the 1930's.
TMPCWA also showed strong support to the workers of Toyota Canada
in launching their Certification Election to form a union. Like
in Toyota Philippines, Toyota always wanted to have no union
policy and even to make all efforts and dirty schemes to prevent
any formation of genuine unionism inside their factories.
Around 3:00
in the afternoon, the protest caravan then went in front of the Cambodian
Embassy, to condemn the Cambodian government against the bloody
attacks and massacre to their protesting workers who are
fighting for decent work and living wages to live decently.
The last embassy hopping ended in front of the Bangladesh
embassy to show our sympathy and pay respect to the garment workers who lost their lives, numbering to more than one
thousand workers, who died on a factory building which collapsed in
Bangladesh. Many families of these workers will now be
sufferings from these incident. We demanded, as TMPCWA, to taking
care of all the family of workers-victims on the Rana Plaza
incident. TMPCWA, inspite of carrying our own struggle, showed
deep and genuine spirit of solidarity and is well aware that we
must also carry our duty to support
the struggling workers of the world.
Around 4:00
pm, TMPCWA proceeded to Toyota Bel-Air, Makati to continue the
last part of the whole day Shame Toyota Campaign. In this Toyota
dealer, two intelligence personnel in a civilian dress was
sighted inside the show room of this building and when the
protestors exposed them, the two police officer intelligence got
mad and provoked the staff of Defend Jobs Philippines, an
organization who is always supporting the activities of TMPCWA.
The two police intelligence got strong reactions when they were
being exposed by the protestors but the protesters did not
shrugged a bit. TMPCWA continued its program and ended it
with high morale and vigilance towards the continuation of our
struggle.

HARASSMENT STARTS AFTER
FEW MONTHS OF LAUNCHING SHAME ON TOYOTA CAMPAIGN

SHAME ON
TOYOTA PROTEST CARAVAN
On
March 17, 2014, the TMPCWA conducted their 13th year
commemorative day of action for the illegally dismissed workers’
campaign and struggle with a protest caravan.
Various organizations participated in the protest caravan (4
jeepneys and two cars participated in the said event). These
are comprised of unions and other mass organizations from the
National Capital Region such as Defend Job Philippines, Kilusang
Mayo Uno-NCR, ANGLO-KMU-NCR, Print Town Workers, Advan Workers,
PISTON-NCR, University Hotel Workers Union, Anakpawis-NCR,
PEDVHA (a vendors’ organization), KADAMAY-NCR, TAMBULI, COURAGE,
Church People-Workers Solidarity-NCR).
It was
a very successful protest caravan that started in front of
Toyota Plant in Sta. Rosa, Laguna. Marching from the Coca-Cola
Plant at around 8:15 AM started the picket and at around 8:30,
the program was started in front of Toyota factory as planned.
During the middle of the program,aneffigy, made by the members
of TMPCWA (a replica of a Toyota vehicle with the logo of Toyota
on the roof and four photos in the front and back windshield
ofNoynoy Aquino and Akio Toyoda on the front and George Ty and
MichinobuSugate at the back), was burned. The photos are symbols
of connivance against exploitation and disrespect to the rights
of the Filipino workers and their continueddisregard to the ILO
Recommendation. LCO (Tolete, the Security personnel from
Logistic Control Officer, who filed criminal complaint against
the workers, that was just recently withdrawn by Toyota)
approached the protestors and told them to move backward saying
that the protestors are almost stepping inside the company
premises.But the protestors remained firm and did not move
backward and they continued the protest.
At
9:30 AM, TMPCWA ended the program and went to Laguna
International Industrial Park, to visit the 3 600 workers who
lost their jobs due to the illegal closure of the company Carina
Apparel. After three speakers (two from TMPCWA and one from
Print Town), who gave their solidarity messages,the group then
marched again going to the factory of Print Town. The program in
front of Print Town Factory lasted for about 30 minutes. There
were 2 speakers from TMPCWA who gave their solidarity message to
the struggle of the Print Town workers and they (TMPCWA
speakers) also shared their own experience and struggles.
At
around 10:30 AM, the protest caravan then travelled to Manila
and went directly to the office of Philippine Daily Inquirer
Group of Companies (in Makati), to continue the protest.The
action lasted for 30 minutes and then the caravan proceeded to
Toyota Makati (Bel-Air). After the program in Toyota Bel-Air, at
around 12:40 PM, the group then stayed for a while near Toyota
Bel-Air. They took their lunch there.
At
1:20 PM,the caravan continuedto travel going to the Supreme
Court (SC) to condemn the unconstitutional decision of the SC to
the 233 dismissed workers. Only the members from TMPCWA made
speeches there. After the protest at the SC,the group then
marched going to DOJ.The program in front of DOJ lasted for
about 40 minutes, two speakers from TMPCWA gave their messages.
The last speaker from KMU-NCR announced that the protest at the
DOJ and the SC was part of the long day protest of TMPCWA on the
13th year of continuous struggle of the illegally
dismissed workers who are determined to fight for justice. Then,
at around 3:15 PM,the caravan then marched to the Court of
Appeals. Only two speakers made their speeches there, one is
Wenny from T4, explained the dismissal and updates on their case
and the speaker is from AGLO-KMU-NCR for the support messages.
Around 3:40 PM, we
arrived at the Department of Labor and Employment. Several
speakers gave their messages to DOLE,especially on the issue of
the ILO Recommendation. At around 4:20 PM, the DOLE security
approached us and informed Ed Cubelo, that the office of the
Secretary would like to have a dialogue. The group, composed of
Ed Cubelo from TMPCWA, Gloria Bongon from Advan Shoe Workers
Union and Mario Maldonado from Print Town, then went inside the
building of DOLE to have their dialogue.

Toyota March 5 Protest Action
On March 5,
2014 another SHAME ON TOYOTA Campaign protest launch by TMPCWA
in a joint protest with illegally dismissed workers of Print
Town under the Philippine Daily Inquirer Group of Companies.
TMPCWA sympathizes and also supporting the fight of the
illegally dismissed workers of Print Town and has agreed to
launch the same day protest with the help of the Defend Job
Philippines and with a support by various organization from
Kilusang Mayo Uno- National Capital Region. The workers from
Bleustar Workers Labor Union (Advan), Alliance of
Nationalist Genuine Labor Organization - ANGLO-KMU-NCR,
Kalipunan ng Damayang Mahihirap (Urban Poor Organization),
PISTON (Operator and Jeepney Drivers Association), Luneta
Vendors Association (PHEDVA) participated in the one day
long protest.
The protest
started in front of Toyota Bicutan, a dealer owned by George Ty.
The next was in the intersection of Pasong Tamo road and Gil
Puyat Avenue to call public attention. There was a short program
before marching towards the head office of Philippine
Daily Inquirer to protest against the illegal dismissal of Print
Town workers. The next stop was in front of Toyota Makati which
is the first time to protest for the Shame Toyota campaign. Many
workers were shocked to know that the very long labor dispute
was not yet over. The workers in Toyota Makati unlike in Toyota
Pasong Tamo has more sympathetic to this case as they thought
that this case was ended. The workers are listening to the
speakers explaining what really happened and all the updates
specially TMPCWA call to implement the ILO Recommendations of
November 2012 and October 2013. The last destination of protest
was in front of the Department of Labor and Employment.

On February
12, 2014 TMPCWA launch Shmae on Toyota protest campaign
and stages protests in front of Toyota dealers in Bicutan,
Paranaque City; Pasong tamo, Makati City; and Manila Bay in
Pasay City. TMPCWA also stage protest in front of Japanese
Embassy before the Manila Bay Dealers and show room of Toyota.
This protest is part of Shame Toyota campaign ot TMPCWA against
the continuous snubbing of Toyota to the November 2012 and the
October 2013 ILO Recommendation that urges both the Philippine
Government and Toyota to find settlement in the very long
standing labor dispute between TMPCWA and Toyota.
Various
organization of workers and peoples organization show strong
support in this campaign and sublime struggle of TMPCWA.
Supporters from the workers headed by the May First Movement
from the National Capital Region (Kilusang Mayo Uno - National
Capital Region Vice Chairperson Larry Jaca made speeches in
front of Toyota Pasong Tamo denouncing Toyota management on
their violation and calling their attention to respect the ILO
recommendation. Church people also show strong solidarity
support in this struggle starting from now on. Father Greg, a
representative of Church People-Workers Solidarity give speeches
in front of Toyota Bicutan and educate Toyota on the social
teachings of the church for the rights of the workers that
should be respected by companies.
Other support
organization was came from the Alliance of Genuine and
Nationalist Labor Organization (ANGLO-KMU-NCR); Defend Job
Philippines; Kalipunang Damayang Mahihirap (KADAMAY- NCR);
University Hotel Workers Union; Robinson Workers Union and
transport group organization (PISTON-NCR).
During the
protest in every Toyota dealers, TMPCWA distributed handbills
and the copy of the request letter to George Ty the chairperson
of G.T. Capital which owns Metropolitan Bank and many other big
Businesses in the country and has the largest share in
Philippine Toyota as well as the President of Philippine Toyota
Michinobu Sugata.
TMPCWA also
denouncing the Philippine Government because of their inutile
stance favoring Toyota and also not respecting the ILO
Recommendation that urging the Philippine Government to
intercede and also to find solution in this case.
In all the
speeches of TMPCWA representative, they call the attention of
all the people and customer and all the potential buyers of
Toyota cars not to buy Toyota vehicles temporarily until Toyota
continue to disrespect the ILO Recommendation.###

TOYOTA CAMPAIGN STARTS AND WILL CONTINUE
UNTIL
TOYOTA WILL NOT IMPLEMENT ILO RECOMMENDATION
Last January
22, 2014 TMPCWA stages a one day protest in some Toyota dealers
(sales offices and showroom) to call the support of all
the local consumers not to buy Toyota vehicles and all of its
components until the time Toyota will seriously take it
responsibility to the illegally dismissed workers and implement
the new ILO Recommendation (November 2012).
The protest
like hopping/ caravan started at Toyota Bicutan in Paranaque
City, where the first factory was located. This Toyota Bicutan
was owned George Ty. The next protest was in front of Toyota
Pasong Tamo in Makati City. This was also owned by George Ty and
was a 12th year consecutive number one dealer of Toyota in terms
of sales, that is why there was strong resistance against the
protest we conducted and some of its management personnel would
like to stop the protest. The third protest was in front of the
Toyota Manila bay dealer, where there are many new establishment
covering in front of this dealer/ sales office. This was also
owned by George Ty. Toyota thought they can escape to our
protest as we always visited this dealer to stage protest every
time we launch protest in front of the Japanese embassy.
Toyota cannot cover their face by erecting new establishment
beside the vicinity of their dealers but it can be a lot of help
to the illegally dismissed workers to exposed to as many people
about the real behavior of Toyota about the treatment to their
workers and the lies behind Toyota's promotion to
corporate social responsibility.
TMPCWA are
calling all the people who support the struggle to do the same
campaign.
Let us
continue to expose and condemn Toyota for the more than ten
years or 13th year of disrespect to the workers basic rights and
the illegally dismissed workers!

TMPCWA YEAR-END ASSEMBLY MEETING
Last December 15, 2013
(Sunday), TMPCWA held a very meaningful year-end general meeting
for the illegally dismissed Toyota workers from 9:00 am to
1:00pm at Barangay Alabang, Muntinlupa City (inside Metro
Manila).
Breakfast was prepared by TMPCWA for the dismissed members
before the opening of the formal meeting. While waiting for the
others who came from far places, TMPCWA made a film showing
presentation entitled PROLETARYO (Proletarian). This is part of
the education program of TMPCWA to give information why the
workers is a proletarian and to give an ideato the dismissed
members about the historical Philippine revolution headed by the
workers and a true hero of the Filipino people, Andres Bonifacio.
The documentary film explained the real situation of Filipino
workers and the people’s struggle for national liberation and
democracy. The film is a great documentary to show to the
dismissed members the importance of the solidarity of all the
workers and oppressed people to advance the struggle for the
common good and interest.
After the filmshowing, the report of the one year activity of
TMPCWA was given by President Ed Cubelo. After the report which
consumes an hour, the floor was opened for questions from the
members for some clarifications. TMPCWA also presented the
attendance report of the members for all the activities launched
by the union. This is to share with the others how often the
dismissed members participated in the program and activity of
the union.
All the members have shared some contribution on the spot to buy
food for the lunch and some others have brought something to eat
that can be shared by everybody. It was a very warm solidarity
expressed by each member of TMPCWA in the spirit of a true
meaning of solidarity in advancing the struggle.
One of the main focuses of the discussion is to advance the
campaign for the implementation of the new ILO Recommendation,
the effort being done by the Philippine Labor Department (DoLE)
and the continuous effort of disrespect by Toyota to the
Recommendation of the ILO.
TMPCWA made a resolution to include George Ty (Banker) and owner
of Metropolitan Bank and the Director and CEO of G.T. Capital
and a partner of Toyota Japan to unmask them together with the
Philippine Government of Aquino, which is collaborating with
each other by not implementing the ILO Recommendation and
following the instruction from the very brain on this dismissal
none other than the number one union buster Toyota Motor
Corporation Japan.
TMPCWA in the very limited capacity by the help of the Support
Group for TMPCWA in Japan distributes some grocery items as a
support donation for the families of the dismissed members in
their celebration of Christmas.
After the General meeting of TMPCWA, everyone proceeded to the
Toyota Bicutan Dealer (a sales office and showroom of Toyota)
owned by George Ty to stage a protest and to inform the public
that this action is a landmark of TMPCWA to unmask the
continuous effort of Toyota and George Ty in ignoring the
International Labor Standard Laws especially in ignoring the
International Labor Organization Recommendation a year after it
was released by the Committee on Freedom of Association.

ONE DAY PROTEST AGAINST TOYOTA

Last December 9, 2013 (Monday), TMPCWA launched a one day
protest against Toyota. The protest was conducted by the
illegally dismissed members to reiterate their call and campaign
for immediate implementation of the ILO Recommendation of the
Governing Body of the ILO and the Committee on Freedom of
Association that urges the Philippine Government and Toyota
Company to end the hardships of the illegally dismissed members
of TMPCWA and their families.
The protest kicked-off in
front of the Department of Labor and Employment (DOLE), to
remind the Labor Department on their responsibilities to
implement the new and strong Recommendation of the ILO. A year
had already pass but the Labor Department is still not doing
anything in urging Toyota to sit over the negotiating table in
line with the ILO Recommendation for negotiated solution on the
very long standing labor dispute between TMPCWA and Toyota.
After the picket in front of the Department of Labor and
Employment, TMPCWA proceeded to the Supreme Court to again stage
protest against the unconstitutional and massacre decision of
the 2nd division which was released in 2008 and was still
unacceptable to the illegally dismissed members and their
families. In this protest, TMPCWA promised the Supreme Court
that series of protest will again be experienced by this Court
to expose the biased judicial system in the country, in
suppressing the rights and welfare of Filipino workers and a pro
capitalist court and government.
After the picket in front of
the Supreme Court, the protestors went to the Court of Appeals
in support for the 4 newly dismissed members of TMPCWA which
were illegally terminated in 2010. TMPCWA reminded the Court of
Appeals that the workers are watching them carefully on their
fair judgment and urging the Court of Appeals judges to issue a
favorable decision for the workers.
Before noon, TMPCWA proceeded in front of the Japanese Embassy
in the Philippines to stage protest and condemn the Japanese
Government in doing nothing against the severe violation of
Japanese owned companies like Toyota to the Filipino workers.
The protestorscried out to the Embassy and Japanese Government
to educate Toyota and the many Japanese Investors to respect the
basic rights of the workers which are clearly stated in the
international labor standard laws for freedom of association and
collective bargaining.
The last part of the day-long activity of the protestors was in
front of Toyota Factory in Santa Rosa, Laguna. TMPCWA strongly
condemned and expose Toyota of the continuing union busting and
urging the company to comply with the international laws and the
strong and favorable recommendation of the ILO to those
illegally dismissed workers. Toyota exposed again its anti
workers and inhuman behaviour by deploying many company guards
which are ready to attack the TMPCWA protest action.
The illegally dismissed workers promised Toyota that the series
of action will be persist, so long as Toyota continues to
ignore the ILO recommendation and the union’s stand and call to
have an honorable negotiation settlement in line with the ILO
Recommendation. ###

Last August
5, 2013 TMPCWA launches protest action to in front of the
Philippine Department of Labor and Employment to call their

protesting members of TMPCWA because the Japanese Embassy is an
extension of Japanese Government in the Philippines that should

condemn Toyota while celebrating its 25 years of staying in the

TMPCWA Succeeded in Getting 10-More-Year-Long Criminal Case
Eternally Dismissed
With an aim to destroy
the union’s fight by strike against Toyota’s mass-dismissal in
2001, Toyota framed up a criminal case alleging only that
security guards suffered from grave coercion as they were
prevented from going in and out of the plant (no physical
contact at all) and has since used it as a lever for attacking
TMPCWA for more than 10 years in the first instance of the case
only.
During these years,
gaining an impetus from ILO recommendation that this criminal
case pending more than ten years is itself a violation of human
rights, TMPCWA has persistently and strongly pushed back such
attack by reinforcing its internal solidarity embracing the
accused members and keeping close association with local and
foreign supporters, especially with Support Group in Japan. In
August last year, TMPCWA exposed and defeated a malicious and
illegal attack jointly schemed by Toyota and the court saying,
“The accused shall be arrested if they do not renew surety
bonds,” thus the hearing proceeded to the next process, the
examination of the complainants themselves. But they did not
appear in the courtroom (for unknown reason), thus the cornered
Toyota, becoming unable to see any favorable prospect for
winning the case, rather found themselves in a very difficult
situation even unable to maintain the case, so that Toyota had
to file a motion for Judicial Dispute Resolution (JDR) (a kind
of criminal settlement proceeding including possible withdrawal
of complaint).
As a consequence, a
JDR meeting took place on last May 28, where the Toyota side
complainants manifested the desistance (withdrawal) of their
complaints and the union side accused accepted it immediately
and unconditionally, thereby the union side succeeded at long
last in getting the court decision to eternally dismiss the case
itself.
Brief Thank-You Note
We thank you very much
for your thoughtful cooperation all the time.
The
current win in the criminal case is a big, big victory that
TMPCWA has got by building its internal solidarity. In such a
situation that it will be no wonder if a lot of difficulties or
different opinions arise even only among the many accused,
TMPCWA strived for pushing back Toyota as well as the court
serving as a helping hand for multinational enterprises, with
the common understanding that the win in the criminal case is
just one transitory step toward the final victory, and thus
adequately responded to an approach from Toyota side without
missing a good chance. As a result of these, the current victory
has been gained.
Fighting against Toyota and also fighting
against the court, thus having finally got this victory – this
has a quite large significance.
Due to a voluminous
docket of cases pending before the court, the hearing took place
only once every three months, which took only a couple of
minutes and ended up with resetting a next hearing date. Such
repetition of hearing date meant the repetition of adjournment,
which made the accused want to almost cry. In the meantime, for
those accused members who have to work at a distant place
including abroad, it was impossible to submit a non-criminal
record certificate that they are required to submit by
recruiting companies. Etc, etc., there were quite lots of
problems.
By fighting and
winning not beaten by such difficulties, it has become possible
to solve the problems, and by getting the victory through
fighting themselves, in the Philippines it seems now that TMPCWA
members have become much more confident of their own power and
much stronger in their internal solidarity and are in greatly
high spirits for getting the victory of their final struggle
from now.

On its 12th year,
Workers gained victory against Toyota!

After 12 long years of persistent struggle and undying vigilance
and defiance towards the harassment of Toyota Motors Philippines
Corporation, the leaders and members of Toyota Motors
Philippines Corporation Workers Association (TMPCWA) today
gained victory against Toyota as the company withdrew the
criminal cases they charged to the 20 leaders and members of
TMPCWA.
In a Judicial Dispute Resolution (JDR) meeting held today at the
Paranaque Metropolitan Trial Court (MTC) Branch 78 under Judge
Ramsey Domingo Pichay, Toyota Company withdrew the criminal case
against the members of TMPCWA as a response to the consistent
struggle for 12 years of the workers in calling for justice and
the immediate dismissal of the case.
Judge Ramsey Domingo Pichay of Paranaque MTC Branch 78 issued an
Order of the court that DISMISSES PERMANENTLY CRIMINAL CASE NOS.
02-0620 and 02-0621 filed against all the accused members of
TMPCWA. Aside from the dismissal of the case, the court also
directs the cancellation and or setting aside of all warrants of
arrest issued against all the accused.
“We consider today as a very momentous and victorious event, not
just for the members of TMPCWA, but also to all the workers in
the country. This fight that took 12 years of our lives had
given us various lessons that we have come to live up to this
very day. Our continued unity and perseverance in facing Toyota
Corporation and these fabricated criminal cases filed against
our leaders and members brought about this victory,” says Ed
Cubelo, President of Toyota Motors Corporation Workers
Association (TMPCWA).
Toyota Motors Corporation was also pressured with the ILO report
issued last November 2012 urging the Philippine Government and
Toyota to 1.)…reinstate the illegally dismissed workers, if not
possible, to reach an equitable solution; and 2.)…withdraw all
criminal cases filed against the officers and members of the
union.
“We know, however, that this victory is only a part of our whole
struggle for justice against Toyota and that we gained this not
just through our unity but also with the support and solidarity
from workers in the Philippines and in other parts of the world
that are with us in this struggle. We are more determined than
ever to gain victory for all the issues and struggles of our
union against Toyota Motors,” ended Cubelo. ###

Celebrates International Workers Day
On May 1,
2013, TMPCWA gather together with various organization of
workers to celebrate international workers day at Plaza
Salamanca Manila located along Taft avenue corner Kalaw road in
Manila City.. The Gathering headed by the Kilusang Mayo-Uno
National Capital Region (KMU-NCR) and Bagong Alyansang Makabayan
- NCR. TMPCWA joins the march towards US-Embassy to support the
call of the workers against the plunder and destroying
environment and natural resources of the country and
exploitation to the FiIlipino workers. TMPCWA also join the
march to Mendiola to where the Philippie President Noynoy Aquino
resides, to show the anger and condemnation of the workers
against its strong policy of not increasing the wage of Filipino
workers since his start of his office like the former regime and
contactualising the workers. Like the experience of TMPCWA the
problem of the long-standing labor dispute between Toyota and
TMPCWA was ignored by him himself when he did not give any
response to the letter appeal of TMPCWA delivered personally by
the president of TMPCWA to Malacanang Palace.##

Years of Struggle of TMPCWA against Illegal Dismissal
Last
March 15, 2013, TMPCWA and the illegally dismissed workers
launched a successful day of protest action against Toyota Motor
Philippines Corporation. This is to commemorate the 12th year of
the massacre done by Toyota to the lives and livelihood of the
233 plus 4 other members of TMPCWA and to their families. The
day-long protest was also conducted to show to Toyota that the
illegally dismissed workers are determine to fight against all
injustices made by Toyota.
The
protest started at the Japanese Embassy in order to remind the
Embassy about their responsibility to educate Toyota to respect
the rights of the Filipino workers while operating in the
country. TMPCWA submitted a request letter to the Embassy
official requesting for a dialogue on the same date.
Unfortunately, the Embassy Official Labor Attaché Mr. Hirata
stopped the dialogue because they do not want any protest action
in front of the Embassy. They also mentioned that the action is
illegal because TMPCWA did not secure any permit from the Police
Authority in the City of Pasay. Despite the explanation of
TMPCWA that the said action is not illegal, rather, a
constitutional right of the workers and the Filipino people, the
Embassy Official Mr. Hirata still threatened TMPCWA to call the
police. Defiant of the ill treatment by the Embassy, TMPCWA
continued the protest. When the police arrived, as per the
instructions of the Embassy, the police grabbed the placard with
the Toyota logo on it. The placard was supposed to be burned as
a sign of protest by the illegally dismissed workers.
The
second part of the program of TMPCWA was staged in front of the
Toyota Manila Bay, one of the Toyota dealer branches owned by
George Ty, the owner of Metropolitan Bank and Trust Company as
well as the Chairman of the Board of Toyota Motor Philippines
Corporation. During the program, three men, each riding a
motorcycle, arrived and it seemed that they were there to
threaten the program. They were wearing jackets, bonnets and
helmets. The illegally dismissed workers forced the men to go
away and the men were forced to move under the bridge and they
just watched the protest.
The
third part of the protest action was staged in front of the
Department of Labor and Employment. This is to condemn the DoLE
by not doing anything despite of the many recommendations of the
International Labor Organization in favor to TMPCWA. The
illegally dismissed workers also condemn the Secretary of the
Department of Labor and Employment for not listening to the 12
years of difficult situation of the illegally dismissed workers
and their families and once again, reminded DoLE to act on this
problem.
The
last part of the protest action was staged in front of the
Toyota Santa Rosa factory in Laguna. When TMPCWA arrive at the
vicinity of Toyota factory, the company security guards were
already waiting, holding truncheons and wooden sticks and
blocking the protesters. At first the Loss Control Officers of
Toyota instructed the security guards to force the protesters to
go and move away, but TMPCWA and its members were determined to
continue the program. TMPCWA condemns Toyota during the program
against all the injustices and exploitation the company had done
to all their workers specially to those illegally dismissed
workers and their families. TMPCWA ended the program by burning
Toyota logo as a symbol of Toyota as a the number one union
buster in the world and more so, as a sign of TMPCWA's
continuing struggle to attain justice for the illegally
dismissed workers.

TMPCWA Year-End Gathering
On December 16, TMPCWA launched the year-end gathering for
the illegally dismissed members and families under the theme ''
12th Christmas of the Workers Illegally Dismissed. Continue to
Struggle for Social Justness and Genuine Justice".
The
program has a two part. The first part is for the
illegally dismissed members discussions to review the whole year
of actions and all the efforts of the union. After the report
all the dismissed members attended had given the chance to asks
questions and to express their real feeling about the struggle
and comes up into a resolution to strengthen the ranks of
TMKPCWA; to
continue to organize; and to continue to struggle for justice. Without
"JUSTICE" we must not STOP! as the dismissed members yells. The
solidarity messages from the Supporting Group of TMPCWA in Japan
was shown to the wall and read by everybody (Message
from the Support Group of TMPCWA in Japan, Message of the
General Secretary of ZENZOSEN KANTO, message from AICHI GROUP of
the Support Group for TMPCWA Steering Committee). All the
members and families are very happy to the very warm solidarity
support providing by the Supporting Group in Japan.
The second
part are the inputs of the workers situation in

for the dismissed members and families as a contribution of
TMPCWA for the midnight Christmas gatherings of each family.

APPEAL of TMPCWA
Dear comrades,
friends, advocates, supporters, organizations and labor unions,
We, are seeking your support to everybody to participate in our
2012 Anti-Toyota Campaign to be held this September! There will
be a long week activity in Japan.
Eleven years (11) have already passed since Toyota massively and
illegally dismissed the 233 members in 2001 and another illegal
dismissal to the four members of the Toyota Motor Philippines
Corporation Workers Association (TMPCWA) in 2010 to bust the
union.
We are still
enduring this struggle together with our family members in
solidarity with our supporters inside and outside the country.
Because of this
undying
struggle of the
illegally dismissed workers, Toyota were forced to
use a desperate means to continue its union busting by utilizing
the pending fabricated criminal cases filed against the leaders
and members of our union to give up the fight.

Toyota continue to harass the
union TMPCWA specially its members illegally dismissed with fabricated
criminal cases. The new harassment started again after the protest action stage by the illegally
dismissed members in front of Toyota factory in Santa Rosa,
Laguna last march 12, 2012. Toyota is utilizing the criminal
case to harass the union. It happened during
the last hearing of the criminal case which still pending in the more than a decade before the Metropolitan Trial Court
(MTC) in Paranaque
Municipal Hall. This criminal case was filed by Toyota after the
strike stages by the union TMPCWA in 2001 was lifted because of
the return to work order by the Department of Labor and
Employment. The lawyer of Toyota strongly requesting the court
Judge
that those jobless members of TMPCWA with a criminal case must renew and pay
the bailbond for the temporary liberty.
Toyota does not like the
union and the illegally dismissed members to stage protest in
front of the factory because Toyota's image to the public is
like a generous company and taking care of the workers welfare
and well-being, but the truth is Toyota has never change his
behavior in violating the workers rights and number one union
buster of the world.

must condemn Toyota!

TMPCWA LAUNCH PROTEST IN FRONT OF TOYOTA
FACTORY
Today, March 12, 2012 the illegally
dismissed members of TMPCWA has register a protest action
in front of Toyota main factory in Santa Rosa Laguna to inform
the management of the company that the illegally dismissed
workers still determine to continue the struggle for genuine
justice. This is the 11th years the illegally dismissed workers
is fighting since the March 16, 2001 massive illegal dismissal
of Toyota to 233 members and all the officers of TMPCWA. Toyota
illegally dismissed the workers because Toyota doesnt want to
have a genuine and militant union inside the facotry.

the Supreme Court
At
this day February 28, 2012, TMPCWA participated in the
protest action together with various organization in the
National Capital Region (Metro Manila) in from of the Supreme
Court of the Philippines. The dismissed workers participated to
call the attention of the Supreme Court Chief Justice to correct
the unconstitutional decision released by Justice Presvitero
Velasco.

TMPCWA brings the case to the
Department of Justice
Last October 10, 2011 in the sixth
(6th) year of International Day of Protest against Toyota,
TMPCWA stage a protest in Front of the Philippine Justice
Department in order to bring the issue of Unconstitutionality of
the Decision of the Supreme Court against the union and
illegally dismissed workers. After the protest at the DOJ, The
union proceed to the Japanese Embassy to register a protest and
to inform the Embassy of Japan that the illegally dismissed
members still continuing the struggle. After the protest in
front of the Japan Embassy, the workers and families went to the
Toyota Manila Bay to let inform the consumers about the evil
actions of Toyota against its workers. Toyota Manila Bay is
owned by George Ty, co- owner of Metropolitan Bank and Trust
Company and Toyota Motor Philippines Corporation. The last
action of the day is at the National Labor Relation Commission (NLRC)
in support for the four (4) newly illegally dismissed by Toyota.
The protest action was supported by Defend Job Philippines,
workers from Asia Brewery Incorporated and the families of the
illegally dismissed workers.

11th YEAR-END CHRISTMAS
GATHERING OF TMPCWA
On the 17th and 18th December
2011, TMPCWA successfully launch the eleventh (11th) year
Christmas gathering for the illegally dismissed members and
families. At this year two days activity were prepared to give
the dismissed members and families the chance to get together
again with good relaxing time in a well known beach resort which
categorizes as the Boracay of Batangas in San Juan province of
Batangas (in south Luzon).
In this activity, the illegally
dismissed members discussed the organising of all Toyota workers
not only at the factory level but including all Toyota network
and autoworkers in the whole National Capital Region (NCR). The
resolution of newly type organizing was made during the
unification of the members of TMPCWA. The new design of this
organising campaign of TMPCWA will benefit the more than a
decade of struggle specially of the illegally dismissed Toyota
workers.
After the unification meeting of the
members and families, TMPCWA distributed some gifts of
Christmast package for each family members. The package is not
expensive grocery items but the union make it sure that the
families can have their food to prepare in the eve of
Christmas. The illegally dismissed members and their families
are very happy to receive it. Most of the family said that this
is one of the most happy year-end gathering they experienced.
Other dismissed members could not able to attend because many of
them could not able to allow to use their vacation leave because
of the fixed season, but they made a confirmation on whatever
decision and resolution to be made in this activity, they are
united with it.
Illegally dismissed member Allan
Vergarra and family donated two pig to make sure the food will
be enough for two days, their families also prepared the cooking
with the help of other dismissed members living close to their
town. Vergarra family also provides containers of mineral water
and dispenser so that hot and cold water will always be there in
case it is needed.
There are solidarity support and
presence from the Kilusang Mayo Uno (May First Movement) -
National Capital Region (NCR) and one of the main speaker during
the meeting in coordination with Defend Job Philippines and
TMPCWA. AKAP BATA member also present and helps TMPCWA for the
children activity during the unification meeting. This children
activity program was design by TMPCWA, so that the children can
surely taken care using the educational program and children
organizing separately, to make it sure those children will
not disturb their parents while attending important
organizational discussion.
This activity will not become possible
without the support and help from the Supporting Group of TMPCWA
in Japan and the ZENZOSEN as the mother Federation and the
German Filipino Friendship-GFF organization in Germany that
provides help to overcome all expenses including Christmas
package.
Before the end of the two days activity
of TMPCWA, the members and their families promised to continue
to struggle and will intensify the organizing effort as well as
supporting all the plan, action and campaign of the union in
both local and international.
